The Trump administration on Friday moved to dismiss the criminal case against Dr. Eithan Haim, the doctor and whistleblower who exposed Texas Children’s Hospital for allegedly continuing child transgender treatments after claiming such treatments had been paused.

“The United States … hereby moves this Court for an order dismissing the Second Superseding Indictment and all open counts with prejudice,” stated the motion filed by Assistant U.S. Attorney John Pearson. Shortly after, U.S. District Judge David Hittner, a federal judge in South Texas, dismissed the case with prejudice.

Haim, 34, faced four felony charges under HIPAA laws for disclosing redacted patient records to conservative journalist Christopher Rufo in 2023, facing prison time if convicted. The documents revealed the hospital’s insertion of puberty blockers in patients as young as 11. Haim, a general surgeon, argued he acted to protect children from harmful and unethical procedures.

Haim maintains the case against him was politically motivated and has argued there were missteps by the Department of Justice under former President Joe Biden. Hittner, an appointee of former President Ronald Reagan, criticized government prosecutors for multiple errors, including withdrawing a lead prosecutor with alleged ties to the hospital.

In June, three armed U.S. marshals arrived at Haim’s door to serve him with a felony indictment. Over the following months, Haim and his wife depleted their savings, leaving them, as he described, “completely alone and hemorrhaging cash.” He started fundraisers for his legal defense fund and even made the rounds on online conservative podcasts with prominent figures like Tucker Carlson and Jordan Peterson, according to the Free Press.

Ryan Patrick, an attorney for Haim, told the Washington Examiner the most interesting part about the dismissal is that the dismissal came from “career staff” in the DOJ “less than week after the previous Biden-appointed U.S. attorney” left the administration.

“So that dismissal is signed by his criminal chief, who is a non political appointee, career staffer. I think that shows the situation of this case within the Department of Justice and within the local office that the career staff is the one who signed this dismissal after the presidential appointee left,” Patrick said.

The dismissal request comes as debates over youth gender transition procedures intensify nationwide. While the Biden administration championed such treatments as “lifesaving,” the Trump administration has taken a completely opposite stance, seeking to protect children from such procedures and emphasizing that the United States will begin to recognize only two sexes.

Meanwhile, dozens of states have passed restrictions on gender care for minors, with lawsuits currently pending in several courts, including a case surrounding Tennessee‘s child protection law pending a decision at the Supreme Court.
