Erika Kirk, the widow of slain Turning Point USA co-founder Charlie Kirk, is urging a Utah judge to decide quickly whether prosecutors have presented enough evidence to send the man accused of murdering her husband to trial, arguing the case should not face further unnecessary delays after a weeklong preliminary hearing.
Joined with the parents of Charlie Kirk, the motion filed Friday asked Utah Judge Tony Graf to “promptly enter its probable cause determination based on the overwhelming evidence presented during the five-day preliminary hearing,” according to court records obtained by the Washington Examiner.

The filing came after prosecutors and defense attorneys wrapped up presenting evidence Friday in the preliminary hearing for Tyler Robinson, 23, who is charged with aggravated murder in the Sept. 10, 2025, fatal shooting of Charlie Kirk on the campus of Utah Valley University.
Although testimony has concluded, Graf scheduled a separate hearing for Sept. 1, when both sides will deliver final legal arguments before he decides whether prosecutors have established probable cause to move the case to trial.
“A prompt determination is imperative in the interest of justice,” the family’s filing states. “The Court is approaching the one-year anniversary of Charlie Kirk’s death. Ten months have passed since the defendant was arrested, and the preliminary hearing has now concluded.”
While acknowledging Robinson “is entitled to a fair trial,” the filing argues “he is not, however, entitled to cause undue delay in the criminal justice process.”

The motion also points to Utah’s Crime Victims’ Rights Act, which guarantees victims “the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant.” The family urged Graf to enter his probable cause determination no later than Sept. 1.
Following the conclusion of the preliminary hearing, the Kirk family released a statement calling it “an important step forward in the pursuit of justice for Charlie.”
“Our family is grateful for the prayers, support, and kindness that has been extended to us, especially through these unimaginably painful and emotionally demanding proceedings,” the statement said.
The family added that “the world has witnessed the overwhelming evidence of what occurred to Charlie that day.”

“Nothing will ever undo the loss of our beloved Charlie,” the statement continued. “As this case moves into its next phase, we pray that truth will continue to be heard through a process that is fair, transparent, and grounded in the facts.”
The preliminary hearing featured five days of testimony and newly revealed evidence as prosecutors sought to convince Graf that there is sufficient evidence to send Robinson to trial.
Among the evidence presented this week was previously unreleased surveillance footage that prosecutors said showed Robinson speaking with members of Charlie Kirk’s staff before leaving campus, changing clothes, and later returning to allegedly shoot Kirk from a rooftop overlooking the event.
Jack Posobiec, a friend of Charlie Kirk and senior editor of Human Events, also described to a reporter on Friday the never-before-seen lead up to the assassination of Kirk that was shown to only members of the public who were seated in the courtroom.

It showed “specifically the part of the Losee Center, the roof, and you see everything … he climbed over, he assembles the gun, he runs over to edge, gets down in a prone position, and you see the time.… and then you see him take the shot,” Posobiec recalled of the footage shown on Friday.
Defense attorneys, meanwhile, spent the week challenging the reliability of DNA testing used to link Robinson to the alleged murder weapon and disputed prosecutors’ contention that Robinson targeted Charlie Kirk because of his politics.
Graf on Friday also sanctioned media outlets for briefly broadcasting on Thursday a letter allegedly written by Robinson, despite a court order prohibiting it from being shown publicly. The letter, which appeared to contain a confession, was inadvertently displayed for as much as a few seconds during Thursday’s proceedings.
Rather than remove cameras from the courtroom, Graf ordered that no exhibits shown during Friday’s hearing could be photographed or broadcast.
Robinson surrendered to authorities two days after Charlie Kirk was killed. He has not yet entered a plea to the aggravated murder charge.
If Graf finds probable cause following the Sept. 1 hearing, the case will proceed toward trial in what is expected to be one of the country’s highest-profile murder prosecutions. Prosecutors have said they intend to seek the death penalty.
